Standard Monthly Tuition Agreement

1. The Services:

Blue Horse Farm LLC will provide client with access to a maximum of four riding classes per month. The riding classes will be 30 minute privates.  Blue Horse Farm LLC will be closed 4 weeks per year to give the lesson horses a break, allow students to compete at horse shows and not to miss lessons, to run special events, and even to give riding instructors a break.

 Blue Horse Farm LLC will also provide access to a group unmounted horsemanship class each week that they are open. 

There is no guarantee that a student will receive the maximum number of classes in a given month.  The student will receive access to our online class booking calendar and it is their responsibility to book classes.  

It may be the case that some months the client gets sick, or the available classes don’t work for the client’s schedule for a number of reasons.  In this situation-  A maximum of one unused class from a previous month will rollover to the following month.  If the lesson is not used the following month it expires. 

2. Client Requirements

Client must show up on time. Client must be wearing proper riding attire- boots with heels, an ASTM/ SEI certified riding helmet, and breechesClient must be coachable, positive, and have a good attitude.

3.Compensation and Payment Terms

Our monthly tuition price is based on the annual value.  Client will put a credit or debit card on file, and it will be automatically charged 300 per month.

Your calendar month begins the day you enroll- and the maximum amount of lessons that you are permitted to take must be used before the same date on the following month.  For example if you enroll on September 5th into the Bronze package- you have until October 5th to take advantage of your 4 riding classes.

5.  No Guarantee and No Refunds

The company does not warrant or guarantee any specific level of performance or results.  The results of your riding program are largely based on the efforts of the student.  There are no refunds, chargebacks, or credit card disputes allowed for any reason.

6. Release of Liability

I am fully aware and understand there is risk of death or personal injury to my child and damage to or loss of his/her personal property which may occur as a result of my or my childs participation. In consideration for my own or my child being allowed to participate in the activities of BLUE HORSE FARM LLC, I, for myself, my child and his/her heirs, administrators, executors, and assignees, make the following agreement: 1. Blue Horse Farm LLC, and any agency, entity, instrumentality, and employee or member thereof, shall not be liable to me or my child for any personal injuries or death or damage to personal property caused by defects, disrepair, or faulty construction of the BLUE HORSE FARM LLC and it’s premises. Blue Horse Farm LLC, as used herein, includes any equipment and/or guides, instructor, volunteers, employee, whether acting officially or otherwise. 2. I hereby agree, from this day forward and until the end of time, to indemnify, release, and hold harmless Blue Horse Farm LLC, and any agency, entity, instrumentality, employee, or volunteer thereof from and against any and all claims or causes of action for damages to property or death or personal injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and or total paralysis, or other ailments that could cause disability arising from my child’s use of BLUE HORSE FARM LLC premises, or from any activity, work, or thing done, permitted, or suffered by my child in or about the Blue Horse Farm LLC premises. 3. I agree to ensure and provide that myself or my child shall wear an ASTM/SEI approved protective helmet every time my child is riding an equine. I agree to instruct and ensure that my child understands and respects barn rules and instructions for the safety of the BLUE HORSE FARM LLC participants and their equines. Blue Horse Farm LLC shall not be liable to me or my child for personal injuries or death or property damage or loss from theft, vandalism, fire, flood, water leaks, hurricane, rain, ice, hail, snow, lightning, wind, explosion, accident, or other causes whatsoever, regardless of whether such injuries, death, or damages are caused in whole or in part by the negligence of Blue Horse Farm LLC or any agency, entity, instrumentality, or employee thereof. 4. IT IS MY EXPRESSED INTENTION THAT THE INDEMNITY PROVIDED FOR IN THIS AGREEMENT IS INDEMNITY BY ME ON BEHALF OF MYSELF AND MY CHILD TO INDEMNIFY AND PROTECT BLUE HORSE FARM LLC FROM THE CONSEQUENCES OF ITS OWN NEGLIGENCE, WHETHER THAT NEGLIGENCE IS THE SOLE OR CONCURRING CAUSE OF THE INJURY, DEATH, OR DAMAGE. 5. I agree that I will never prosecute or in any way aid in prosecuting any demand, claim, or suit against Blue Horse Farm LLC for any loss, whatsoever as a result of my child taking part in the equine activities.
